Yesterday, we talked about how you may “diagnose” a land issue is a criminal case and should be reported to the police.
Today, we want to look at what you can do to protect your land when the case isn’t criminal in nature.
1. PRESERVE THE STATE OF THE LAND
If someone is trying to put or remove something from your land, report to the LC authorities or police to stop a person from constructing on your land.
According to the law, the one in possession of the land has rights until the courts say otherwise.
2. APPLY FOR AN INJUNCTION
If you can get to court, ask the court to stop the trespasser from doing anything with your land until the court decides who rightfully owns the land. This court order is called an “Injunction”. It preserves the state of the land or property.
3.LODGE A CAVEAT
If you have bought land, or been given land or have any interest in a piece of land, you should always register (lodge) a caveat on it to stop anyone from registering your land as their own. This is the easiest way to protect your ownership by stopping anyone from transferring it, using it for a loan or registering it as their own.
